Judge: Thomas S. Mcconville, Case: 2022-01257052, Date: 2023-07-17 Tentative Ruling

Defendants Concept Millwork Design & Development, Inc., Richard Gubler, and Cindy Gubler’s demurrer to the Complaint is OFF CALENDAR.

 

On 6-5-23, the court found that moving parties’ meet and confer declaration did not comply with Code Civ. Proc., § 430.41, subd. (a), and ordered the parties “to engage in Code-compliant meet and confer efforts,” as well as ordering “counsel for moving parties to file a supplemental declaration demonstrating such compliance at least five court days prior to the hearing.”  (See 6-5-23 minute order [ROA 56].)

 

The court also observed that the proof of service of plaintiff’s Opposition to the demurrer was defective, and ordered plaintiff’s counsel to re-serve the Opposition, along with a notice of continuance, and to give notice of the continued hearing date.  (Id.)

 

None of the parties have complied with these orders, as there are no new documents filed regarding the demurrer.

 

Accordingly, the demurrer is ordered OFF CALENDAR.
