Ardalan v. Borchardt

The court issues its rulings regarding the motion of certain Defendants filed in action no. 21STCV15057 to compel against the Borchardts (6746).

          Regarding the form interrogatories, the Borchardts shall respond without objection to form interrogatory nos. 1.0, 1.1, 2.5.  The Borchardts shall provide a code-complaint response to document request nos. 41 (up to date of lease application for the premises at issue), 49 (to the date of surrender of premises at issue), 64 (limited to sufficient documents to show the information sought), 65 (limited to sufficient documents to show the information sought).  And produce all responsive documents.

          Genevieve Borchardt shall provide a code-complaint response without objection to form interrogatory no. 12.4 and document request nos. 7, 19, 20, 22.  And produce all responsive documents.

          Francesca Borchardt shall provide a code-compliant response without objection to form interrogatory no. 12.4 and document request nos. 5, 6, 17, 19, 22.  And produce the responsive documents.

          The Borchardts shall provide a code-compliant response without objection to request for admission nos. 3, 4, 7, 8, 9, 11, 12, 14 and provide a code-compliant response without objection to form interrogatory no. 17.1, when applicable. 

          The Borchardts shall provide a code-compliant response without any objection other than attorney-client privilege and work-product protection and produce the responsive documents for document request nos. 1, 2, 3, 4, 5, 6, 7, 9, 14, 15, 16, 17, 18, 19, 20, 21, 22, 25, 26, 27, 28, 29, 30, 31, 32, 35 (relating to the premises at issue), 36, 37, 38, 39, 41 (up until Borchardts vacated the premises), 49 (to date of surrender of the premises), 50, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, 61, 62, 63 (relating to the premises at issue), 64 (limited to documents sufficient to show), 65 (limited to documents sufficient to show), 66 (to date of surrender of the premises).

For any documents withheld on grounds of privilege, the Borchardts shall provide a code-compliant descriptive log.  All requests for sanctions are denied.  Compliance within 20 days.
