FACTUAL
BACKGROUND
This
is an unlawful detainer action. Plaintiff Metro Investments Group, Inc. filed a
complaint against Defendant Jasmine Valdivia for a 3-Day Notice to Pay or Quit.
Plaintiff alleges Defendant failed pay rent.
Default
was entered February 21, 2023. The
request to set aside default was granted March 22, 2023.
TENTATIVE RULING: GRANT
Counsel
contends the client has breached a material term or obligation, to Counsel, relating
to the representation and Counsel has given the client a reasonable warning after
the breach that Counsel will withdraw unless the client fulfills the agreement
or performs the obligation and there has been a breakdown in the attorney
client relationship.
Counsel
has complied with the requirements of CRC Rule 3.1362 by filing forms MC-051
and MC-052 and lodging with the Court a copy of the proposed order on form
MC-053. Counsel confirmed Plaintiff’s last known address by conversation and
the California Secretary of State Business Search.
Trial
is not set. The next hearing is May 17, 2023 for a Case Management Conference.
Accordingly,
the Motion to be Relieved as Counsel is GRANTED. Counsel is to warn Metro Investments Group,
Inc. that it can only appear through counsel because it is a corporation, and
corporations cannot proceed in pro per.
