Defendant’s (North Orange County Community College District) Amended Motion to Compel Responses to Form Interrogatories-Employment Law, Set One (Motion), filed on 3-7-23 under ROA No. 285, is GRANTED. The Amended Notice for this Motion (Notice) was filed on 3-7-23 under ROA No. 287.)
Code of Civil Procedure section 2030.290 states, in part, “If a party to whom interrogatories are directed fails to serve a timely response, the following rules apply: . . . [¶] (b) The party propounding the interrogatories may move for an order compelling response to the interrogatories.”
On 1-24-23, Defendant served Plaintiff (Khourt Williams) with “Form Interrogatories—Employment Law Set No. 1.” (Modafferi Decl., ¶ 3 and Exhibit A.) As of 3-6-23, Defendant had not received any responses to this discovery request. (Modafferi Decl., ¶ 7.)
The Motion seeks further responses to Form Interrogatory (FI) Nos. 210.1, 210.2, 210.3, 210.4, 210.5, 210.6, 212.1, 212.2, 212.3, 212.4, 212.5, 212.6, 212.7, 213.1, and 213.2. (Motion; 2:14-16.) The Notice of Errata, filed on 3-7-23 under ROA No. 285, indicates that Defendant also seeks to compel responses to FI Nos. 202.1 and 202.2
Since Plaintiff has not provided any responses to this discovery request, the court GRANTS Defendant’s (North Orange County Community College District) Motion to Compel Responses to Form Interrogatories-Employment Law, Set One filed on 3-6-23 under ROA No. 271. The court ORDERS Plaintiff to provide verified responses, without objection, to FI Nos. 202.1, 202.1, 210.1, 210.2, 210.3, 210.4, 210.5, 210.6, 212.1, 212.2, 212.3, 212.4, 212.5, 212.6, 212.7, 213.1, and 213.2 within 21 days of the date of service of the notice of the court’s ruling. (Code Civ. Proc., §§ 2030.250 and 2030.2030.290, subd. (a).) The court awards a monetary sanction in the amount of $750.00 in favor of Defendant and against Plaintiff. (Code Civ. Proc., § 2030.290, subd. (c), and Cal. Rules of Court, rule 3.1348; Modafferi Decl., ¶¶ 8, 9, and 10.)
