Defendant’s (American Financial Center, Inc.) Motion for Sanctions Against Plaintiff Anh Thy Song Nguyen, Trustee of Mother Nature Trust, and its Counsel, Andrew Smits, filed on 5-26-20 under ROA 148, is CONTINUED to a date to be determined at the hearing on 7-26-22.

Defendant’s Motion for Monetary Sanctions Against Michael A. Younge and the Law Office of Michael A. Younge, Counsel for Plaintiff, filed on 1-18-22 under ROA 633, is CONTINUED to a date to be determined at the hearing on 7-26-22.

The court declines to decide the issue of sanctions under Code of Civil Procedure section 128.7 at this stage because Defendant has not yet filed its responsive pleading to Plaintiff’s Third Amended Complaint. The parties shall appear at the hearing on 7-26-22 prepared to discuss an appropriate hearing date for this motion in light of Defendant’s anticipated response to the Third Amended Complaint.
