Moving Counsel’s (James Hornbuckle) Motion to Be Relieved as Counsel, filed 10-6-22 under ROA No. 115, is DENIED without prejudice.

On 10-27-22, the court granted Plaintiff’s Ex-Parte Motion to be Relieved as Counsel of Record as to the request for order shortening time, under ROA No. 128. The court’s 10-27-22 order stated that Moving Counsel was to “. . . give notice and re-serve the motion, declaration and proposed order with the 12/06/2022 hearing date.” (10-27-22 Minute Order.)

The court’s file does not reflect that Moving Counsel’s client (Alejandro Lozoya Gomez) received notice that the Motion was set on 12-6-22 by way of the court’s 10-27-22 Minute Order. (Cal. Rules of Court, rule 3.1362(d).) Thus, the court DENIES Moving Counsel’s (James Hornbuckle) Motion to Be Relieved as Counsel, filed 10-6-22 under ROA No. 115, without prejudice.
