Judge: Walter P. Schwarm, Case: 30-2021-01202071, Date: 2022-12-13 Tentative Ruling

Moving Counsel’s (Farhad Novian, Sean Bozarth and Novian & Novian LLP) unopposed Motion to Be Relieved as Counsel as to Retrolock Corporation (Motion), filed on 11-14-22 under ROA No. 66, is GRANTED.

 

The Motion complies with California Rules of Court, rule 3.1362 (a), (c), and (d).  On 11-14-22, Moving Counsel served the Motion, the Declaration, and the Proposed Order on Defendant (Retrolock Corporation).

 

The declaration filed on 11-14-22 under ROA No. 64 states in part, “Recently, it has become clear that irreconcilable difference have arisen between out law firm and our client and there has been a breakdown in communication.  This has made it virtually impossible for out law firm to effectively represent Retrolock Corporation in this action. . . .” This declaration is sufficient to justify withdrawal under Professional Conduct Rule, 1.16, subdivision (b)(4).

 

Moving Counsel will remain as counsel of record until Moving Counsel files proof of service of the court’s signed order on Tanya Pierce.

 

Based on the above, the court GRANTS Moving Counsel’s (Farhad Novian, Sean Bozarth and Novian & Novian LLP) unopposed Motion to Be Relieved as Counsel as to Retrolock Corporation filed on 11-14-22 under ROA No. 66.
