Moving Counsel’s (Samer Habbas, Gregory Grigorian, collectively Law Offices of Samer Habbas) Motion to Be Relieved as Counsel, filed 6-21-22 under ROA No. 41 is DENIED without prejudice.

 

On 8-1-22, the court granted Plaintiff’s Ex Parte Application for Order Shortening Time to Hear Counsel’s Motion to be Relieved as Counsel under ROA No. 71. The court’s 8-1-22 order stated that Plaintiff was to “re-served [sic] all parties of new Motion to Be Relieved as Counsel of Record hearing.”

 

On 8-2-22, Plaintiff’s counsel filed Proof of Service by Mail under ROA No. 75. This document indicates that Plaintiff’s counsel served Defense counsel with Notice of Change of Hearing Date on Motion to be Relieved as Counsel. Plaintiff’s counsel did not file this document with the court. It is also unclear whether Plaintiff was also served with this document.

 

Therefore, the court’s file does not reflect that Moving Counsel’s client (Muna Aboabdo) received notice that the Motion was set on 9-27-22 by way of the court’s 8-1-22 Minute Order. (Cal. Rules of Court, rule 3.1362(d).)
