Defendant’s (Emmanuel Dapidran Pacquiao) Motion for Judgment Notwithstanding the Verdict (Motion), filed on 5-17-23 under ROA No. 777, is CONTINUED to 9-12-23 at 9:00 a.m. in Dept. C32.

The parties are ordered to file any part of the trial transcript that pertains to the Motion for Nonsuit or Motion for Directed Verdict, including but not limited to the portions on 4-26-23 or 4-27-23 within 10 days of this order. The parties are further ordered to deliver a copy of the admitted trial exhibits to Dept. C32 within 10 days of this order.

The parties are also ordered to submit supplemental briefing as to whether Defendant’s Request for Judicial Notice (ROA 725) filed in conjunction with the Motion for Nonsuit can be considered by the court as evidence from the trial for purposes of this Motion. Further, can the court consider counsel’s representations made during the hearings on the motions for nonsuit and directed verdict as evidence from the trial for purposes of this Motion. The supplemental briefing shall not exceed five (5) pages shall be filed no later than 8-31-23.

Therefore, the court CONTINUES Defendant’s (Emmanuel Dapidran Pacquiao’s) Motion for Judgment Notwithstanding the Verdict, filed on 5-17-23 under ROA No. 777 to 9-12-23 at 9:00 a.m. in Dept. C32.
