Motion No. 1:

Moving Counsel’s (Law Office of Cary S. Macy) unopposed Motion to Be Relieved as Counsel as to Shaun Etchegoyan, filed on 8-1-22 under ROA No. 105, is GRANTED.

The Motion complies with California Rules of Court, rule 3.1362 (a), (c), and (d).  On 8-1-22, Moving Counsel served the Motion, the Declaration, and the Proposed Order on Defendant (Shaun Etchegoyan).

The declaration filed on 8-1-22 under ROA No. 101 states, “Irreconcilable difference have arisen between client and attorney making it unreasonably difficult to carry out the employment effectively and the client would not voluntarily sign and substitution of attorney.” This declaration is sufficient to justify withdrawal under Professional Conduct Rule, 1.16, subdivision (b)(4).

Moving Counsel will remain as counsel of record until Moving Counsel files proof of service of the court’s signed order on Shaun Etchegoyan.

Based on the above, the court GRANTS Moving Counsel’s (Law Office of Cary S. Macy) unopposed Motion to Be Relieved as Counsel as to Shaun Etchegoyan, filed on 8-1-22 under ROA No. 105.

Motion No. 2:

Moving Counsel’s (Law Office of Cary S. Macy) unopposed Motion to Be Relieved as Counsel as to MME Consultants and Design LLC, filed on 8-1-22 under ROA No. 106, is GRANTED.

The Motion complies with California Rules of Court, rule 3.1362 (a), (c), and (d).  On 8-1-22, Moving Counsel served the Motion, the Declaration, and the Proposed Order on Defendant (MME Consultants and Design LLC).

The declaration filed on 8-1-22 under ROA No. 103 states, “Irreconcilable difference have arisen between client and attorney making it unreasonably difficult to carry out the employment effectively and the client would not voluntarily sign and substitution of attorney.” This declaration is sufficient to justify withdrawal under Professional Conduct Rule, 1.16, subdivision (b)(4).
