[TENTATIVE] ORDER RE: PLAINTIFF MADISON CASTELLANOS' MOTION TO COMPEL FURTHER RESPONSES TO DEMAND FOR PRODUCTION OF DOCUMENTS, SET TWO

Plaintiff’s Demand for Production Nos. 74-81:

Request: All video footage from both video cameras located within CDC 122 at West Los Angeles College, located at 9000 Overland Avenue, Culver City, CA, for June [6, 7, 8, 9, 10, 13, 14, 15], 2022 from 10:00 am to 2:00 pm.

Ruling: DENIED.  The incident took place 4 years ago and the probative value of the video footage is too low to justify the invasion of privacy of third-parties, including minors, even if a protective order is entered into. 

Plaintiff’s request for sanctions is DENIED.  Defendant’s request for sanctions is GRANTED in the reduced amount of $675 consisting of 3 hours at defense counsel’s hourly rate of $225.  Sanctions are to be paid within 20 days of the date of this order.
