On November 5, 2020, Abdelrahman Mustafa Abdelrahman (“Plaintiff”) filed this action against Pacific Traffic Control, Inc. (“Pacific”) and Francisco Javier Proa Naranjo for injuries arising from a motor vehicle collision. On September 6, 2022, Defendant Pacific served on Plaintiff Requests for Admission. Plaintiff failed to respond. Defendant seeks an order to deem the requests admitted.

Defendant Pacific served this motion on Plaintiff by mail on September 6, 2022, from Kentucky. Therefore, 16-court days of notice is increased by 10 calendar days, making the opposition due on November 22, 2022. Code Civ. Proc., § 1013(a). No opposition has been filed.

Where a party fails to respond to requests for admission, the court can deem the requests admitted against the non-responding party. Code Civ. Proc., § 2033.280(c). Plaintiff did not serve responses to Requests for Admission, Set One. Declaration Brandye Foreman, ¶ 5. Accordingly, the court deems the requests admitted against Plaintiff.
