[TENTATIVE] ORDER RE: PLAINTIFF’S MOTION FOR LEAVE TO FILE FIRST AMENDED COMPLAINT

Before the Court is Plaintiff’s motion for leave to file an amended complaint.  However, the Court lacks jurisdiction to rule on this motion because the case was removed to federal court on August 8, 2022.  In a minute order dated August 23, 2022, the Court vacated all hearing dates and scheduled a non-appearance case review for November 30, 2022.  If the Court did not receive a remand order by then, and if there is no request from counsel that the vacated hearing dates are reinstated the Court would consider the Superior Court action closed.   

No remand order has been received and no request from counsel has been made to reinstate the trial or final status conference dates. 

Accordingly, the Court takes the motion off calendar.
