[TENTATIVE] ORDER RE: MOTION TO BE RELIEVED

Kamyar R. Shayan (“Counsel”) seeks to be relieved as counsel of record for plaintiff Uriel Miranda (“Plaintiff”) on grounds that the relationship of trust and confidence essential to the attorney-client relationship has ceased to exist.  Absent a showing of resulting prejudice, an attorney’s request for withdrawal should be granted.  (People v. Prince (1968) 268 Cal.App.2d 398, 406.) 

The Court notes that trial in this matter is currently set for October 19, 2022, and no defendant has been served with the summons and complaint.  However, the proposed order filed on August 10, 2022 lists Plaintiff’s address as “last known”, which contradicts Counsel’s most recent September 14, 2022 declaration that he has been able to confirm his client’s address as current.  Accordingly, the hearing on this motion to be relieved is continued to October 25, 2022 at 1:30 p.m. so that Counsel may submit a revised order.
