[TENTATIVE] ORDER RE: MOTION TO BE RELIEVED

Dept. 27

1:30 p.m.

October 25, 2022

Kamyar R. Shayan (“Counsel”) seeks to be relieved as counsel of record for plaintiff Uriel Miranda (“Plaintiff”) on grounds that the relationship of trust and confidence essential to the attorney-client relationship has ceased to exist.  Absent a showing of resulting prejudice, an attorney’s request for withdrawal should be granted.  (People v. Prince (1968) 268 Cal.App.2d 398, 406.)

Trial in this matter is currently set for November 2, 2022, and no defendant has been served with the summons and complaint. The Court finds that no prejudice will result from the granting of this motion.  Accordingly, the motion to be relieved is GRANTED and effective upon filing a proof of service showing service pf the order on Plaintiff.
