[TENTATIVE] ORDER RE: MOTION TO BE RELIEVED

Paul M. Krueger, Esq. of Barry and Krueger seeks to be relieved as counsel of record for Plaintiff Tiahna Vince.  Counsel declares that the failure to communicate and other conduct renders it unreasonably difficult for him to carry out the representation effectively.  Absent a showing of resulting prejudice, an attorney’s request for withdrawal should be granted.  (People v. Prince (1968) 268 Cal.App.2d 398, 406.) 

Counsel’s Motion complies with California Rules of Court, Rule 3.1362.  The Court notes that trial in this matter is not yet set and no prejudice will result from granting this motion.  However, a revised proposed order is needed.  Accordingly, the hearing on this motion is continued to November 10, 2022 at 1:30 p.m. so that Counsel may submit a revised proposed order identifying the new OSCs re: Dismissal scheduled for January 26, 2023 and May 8, 2024.
