          On September 15, 2023, defendant Sunbelt Rentals, Inc. (“Defendant”) filed this motion for an order compelling plaintiff Ivan Cervantes to serve further responses to Requests for Admission (Set Two). The motion also requests sanctions against Plaintiff and his counsel of record for $1,580.

          On December 14, 2023, Plaintiff filed an opposition brief and Plaintiff’s counsel declared that further responses had been served. While the motion may be moot, the Court may award sanctions in favor of Defendant. In this case, the Court imposes sanctions because Plaintiff served amended responses only after seven months and failed to respond to Defendant’s attempts to meet and confer.

          Accordingly, Defendant’s request for sanctions is GRANTED and imposed against Plaintiff and counsel of record, jointly and severally, in the amount of $630, consisting of 3 hours at an hourly rate of $190 and a $60 filing fee, payable within 10 days.
