[TENTATIVE] ORDER RE: MOTION TO SPECIALLY SET THE HEARING ON THE MOTION FOR SUMMARY JUDGMENT ON BEHALF OF DEFENDANTS, MICHAEL AARON LALEZARIAN, M.D. AND MICHAEL AARON LALEZARIAN, M.D., CORP.

On June 1, 2021, Plaintiff Jose Solis (“Plaintiff”) filed this action against Defendants Michael Aaron Lalezarian, M.D., Corp. and Michael Aaron Lalezarian, M.D. (collectively, “Defendants”).  On October 18, 2022, Defendants filed this motion for an order specially setting the hearing on their summary judgment motion or, in the alternative, continuing the current trial date of June 27, 2023 to allow their summary judgment motion to be heard.  Defendants’ summary judgment motion was filed on September 25, 2022 and the first hearing date available was November 13, 2023, which is more than 5 months after the current trial date. 

The Court Reservation System allocates the available hearing schedule and the Court will not override it by specially setting a hearing without exceptional grounds.  That is because specially setting a hearing will likely require that another matter scheduled for that time be continued.  Defendants fail to provide any facts demonstrating extraordinary circumstances; accordingly, the Court will not specially set a hearing for their summary judgment motion. 

In lieu of specially setting a hearing date, the Court instead continues the trial date from June 27, 2023 to January 30, 2024.  The final status conference is continued from June 13, 2023 to January 16, 2024.  All discovery and motion cut-off deadlines are to be based on the new trial date.

Parties who intend to submit on this tentative must send an email to the Court at SSCDEPT27@lacourt.org indicating intention to submit on the tentative as directed by the instructions provided on the court website at www.lacourt.org.  Please be advised that if you submit on the tentative and elect not to appear at the hearing, the opposing party may nevertheless appear at the hearing and argue the matter.  Unless you receive a submission from all other parties in the matter, you should assume that others might appear at the hearing to argue.  If the Court does not receive emails from the parties indicating submission on this tentative ruling and there are no appearances at the hearing, the Court may, at its discretion, adopt the tentative as the final order or place the motion off calendar.
