[TENTATIVE] ORDER RE: APPLICATION FOR DEFAULT JUDGMENT

Dept. 3

8:30 a.m.

August 28, 2023

Plaintiff AATC & Koo LLC (“Plaintiff”) seeks a default judgment against Wenyang Lu and The Magic Herb (collectively, “Defendants”) in the amount of $43,022, consisting of $40,537 as demanded in the complaint, $485 in costs, and $2,000 in attorney fees.  The default package is incomplete and cannot be approved for the following reasons:

1)   No proposed judgment is on file.

2)   The request for attorney fees is not calculated according to Local Rule 3.214.  Counsel does not explain why $2,000 in attorney fees is warranted instead of $1,606.11.

The Default Prove-Up Hearing is continued to ________ at 8:30 a.m. in Department 3 of the Alhambra Courthouse.

Dated this 28th day of August, 2023
