[TENTATIVE] ORDER RE: MOTION TO VACATE STAY

On February 6, 2025, a status conference was held in this department and the Court ordered the case stayed until March 28, 2025, so that defendant South Atlantic Investment LLC’s (“SAI”) motion to compel arbitration could be heard.

Notwithstanding this order, Joy CA, LLC (“Joy”) on February 24, 2025, filed this motion to vacate the stay. The hearing date reserved for this motion was March 19, 2025, less than 7 court days before the scheduled hearing on SAI’s motion to compel arbitration. Joy’s motion to lift the stay is brought on the premise that it would be prejudiced by further delay due to an inability to complete discovery. (Motion, p. 1.) No prejudice will result from waiting 7 court days until March 28, 2025. Accordingly, the motion to vacate the stay is DENIED.
