[TENTATIVE] ORDER RE: DEFAULT PROVE-UP PURSUANT TO CCP § 585

Plaintiff Brian Whitaker (“Plaintiff”) requests a default judgment against defendant Valentine Sweets, LLC (“Defendant”) in the amount of $8,012.41.  Plaintiff alleges Defendant violated the Unruh Civil Rights Act by providing dining tables which sufficient toe and knee clearance under the tabletops for individuals using wheelchairs for mobility.  Plaintiff requests $4,000 in damages, $3,225 in attorneys’ fees, and $787.41 in costs.  However, $200 of his costs are unspecified.  (Form CIV-100, Item 7c.)  Accordingly, the hearing is continued to________ so that Plaintiff may explain the source for all of his sought-after costs or remove any items not allowed by CCP 1033.5(b), such as investigation costs.
