Plaintiff Manak Jewels, Inc. (“Plaintiff”) seeks a default judgment against defendant Mimi et Cie, LLC (“Defendant”) in the amount of $43,531.64. However, the application is deficient because Plaintiff’s declaration in support of the default judgment is signed by Ambrish Sethi (“Sethi”). Sethi fails to establish their personal knowledge of the facts stated within and, as a result, fails to authenticate the records attached to it. Therefore, Plaintiff fails to substantiate the judgment sought.

The default prove-up hearing is continued to _____________ at 8:30 a.m. in Department 3. Papers must be submitted no later than 5 court days before the date of the hearing.
