[TENTATIVE] ORDER RE: MOTION TO COMPEL ANSWERS TO SPECIAL INTERROGATORIES

On September 18, 2024, plaintiff Antares Dianne Vice-Clemente (“Plaintiff”) filed this action against defendants Arina X. Ohanyan and Liana R. Hovhannisyan (collectively, “Defendants”).

On November 13, 2024, Defendants served Special Interrogatories (Set Number One) on Plaintiff. Despite being given an extension, Plaintiff failed to serve responses by the agreed-upon deadline. This motion was filed on March 19, 2025.

Where a party fails to serve timely responses to discovery requests, the court may make an order compelling responses. (Code Civ. Proc., § 2030.290.) A party that fails to serve timely responses waives any objections to the request, including ones based on privilege or the protection of attorney work product. (Code Civ. Proc., § 2030.290, subd. (a).)

Plaintiff did not oppose the Motion and it is undisputed responses were not served. Defendants’ Motion is GRANTED and Plaintiff is ordered to serve verified responses without objections to Defendants’ Special Interrogatories (Set Number One) within 20 days of the date of this Order.

Although defense declaration includes a request for sanctions, no request was made in the notice of motion or the memorandum of points and authorities, therefore no sanctions shall be imposed. (Code Civ. Proc., § 2023.040.)
