Plaintiff’s motion for final approval of class action settlement is CONTINUED to December 16, 2022 at 9:00 a.m. for the parties to address the following items of concern.  Any supplemental briefing shall be filed on or before December 7, 2022.

Counsel previously represented under oath that the class size as of January 2022 was approximately 989.  (ROA 79, ¶ 9.)  Per the administrator’s declaration, the class size at final approval is 876.  What accounts for this discrepancy?  What class size did counsel use to value the case?  Does this discrepancy affect the reliability of the valuation?
