Plaintiff Miguel Catalan's Notice of Motion and Motion for Preliminary Approval of Class Action Settlement   ROA #124

Plaintiff Miguel Catalan moved for preliminary approval of the parties’ class action settlement on May 27, 2022.  On June 28, 2022, the Court issued a minute order continuing the motion to August 5, 2022 and requesting supplemental briefing on a number of items of concern by July 27, 2022.  The requested supplemental briefing was not filed.  On August 4, 2022, the Court issued a minute order continuing the August 5 hearing to September 22, 2022 and setting a deadline of September 12, 2022 for the supplemental briefing.

As of September 20, 2022, no supplemental briefing has been filed.  Because the parties have twice failed to file the requested supplemental briefing, the motion is DENIED WITHOUT PREJUDICE.  Should Plaintiff file a renewed motion for preliminary approval, the Court expects that the moving papers will address all items of concern mentioned in the June 28 minute order.

Counsel for the parties are ordered to appear at the hearing (either in person or via Zoom) to discuss future steps to be taken in this litigation.
