Plaintiff Adrian Hernandez Barrientos' Motion to Aprove PAGA Settlement  ROA# 66

At the initial hearing on this motion on 07-08-22, the Court identified 12 areas of concern and ordered the parties to file a response no later than 08-12-22. (ROA 75.) No such filing has been made. Instead, the parties have filed dueling attorney declarations, asking for additional time to meet and confer and seeking guidance from the Court. (ROA 78, 80.) 

The parties are ordered to appear (either in person or via Zoom) to discuss the disputed issues. As things now stand, the Court’s intention is to CONTINUE Plaintiff’s motion for approval of PAGA settlement to 10-14-22 at 9:00 a.m. in Department CX104. Supplemental briefing shall be filed no later than October 4, 2022.  If a revised settlement agreement is submitted, a redline version showing all changes, deletions, and additions must be submitted as well.  In addition, Plaintiff must provide proof of service of any revised settlement agreement and supplemental papers on the LWDA.
