Defendant Construction Development Management, Inc.'s Attorney's Notice of Motion and Motion to be Relieved as Counsel ROA 82

Attorneys Beth A. Kahn and Keith Rossman and the firm of Clark Hill LLP’s motion to be relieved as counsel of record for Defendant Construction Development Management, Inc. is GRANTED subject to the submission of the proposed order described below. The order will be effective upon the filing of proof of service of the order on the client.

The Court hereby sets an order to show cause regarding striking the answer of now-unrepresented corporate party Construction Development Management, Inc. The order to show cause is set for hearing on September 21, 2023 at 8:30 a.m. in Department CX104. The order to show cause shall go off-calendar if representation is obtained by Defendant by September 21, 2023.

In addition, the status conference currently scheduled for September 5, 2023 is continued to September 21, 2023 at 8:30 a.m. in Department CX104, to be heard at the same time as the order to show cause. A joint status conference statement is to be filed on or before September 14, 2023. In the event Defendant has not obtained new representation by September 14, Plaintiffs are to file a status conference statement on their own behalf.

Moving counsel is to submit a proposed order on Judicial Council Form MC-053 forthwith for the Court’s approval. Section 8 of the proposed order should note the rescheduled status conference, and section 13 should reflect the foregoing order to show cause, including the potential effect of the striking of the answer on Defendant.
