Plaintiff Alejandro Ramirez's Notice of Motion and Unopposed Motion For Preliminary Approval of Class Action Settlement and For Leave to File First Amended Complaint ROA 58

The Court has reviewed the briefing submitted in response to the prior minute order. The Court is inclined to GRANT the motion for preliminary approval of class action settlement. However, at the hearing, the parties should be prepared to address the following issue:

Plaintiff’s counsel testifies that Courthouse News Service and LWDA website searches showed no outstanding matters that could be affected by this settlement. However, the search results appended to his declaration both show a wage-and-hour suit and a PAGA claim titled Sanchez v. M. De Anda Enterprises, currently pending in Los Angeles County Superior Court. Is there any relationship between M. De Anda Enterprises and De Anda Enterprises, the defendant here?

Assuming this issue is adequately addressed, the Court will grant preliminary approval of the parties’ settlement, as amended, and also approve the current version of the notice. The motion for final approval shall be heard on February 2, 2024 at 9:00 a.m. in Department CX104. Moving papers are due 16 court days before the hearing. 

Please submit a revised proposed order that conforms to the foregoing, includes the date of the final approval hearing, and updates all dates that are calculated in reference to the date preliminary approval is granted.
