The unopposed applications of Melissa Ephron and Melissa Hague for pro hac vice admission are DENIED WITHOUT PREJUDICE to the refiling of applications that address the below item of concern.
CRC 9.40 requires an attorney seeking pro hac vice admission to serve his or her application on the State Bar and pay the State Bar a $50 fee. Ms. Ephron’s and Ms. Hague’s applications each state that they have “made arrangements” to serve the State Bar and pay the required fee, not that service and payment have actually been made. Before the Court will grant their applications, proof of service on and payment to the State Bar must be provided. If revised applications addressing this concern are filed, the Court is inclined to grant their requests for pro hac vice admission.
Separately, the Court’s file does not reflect the filing of an answer or other responsive pleading by Defendant Sofregen Medical, Inc. If Sofregen filed a responsive pleading when this case was pending in federal court, the Court asks that it re-file the answer here.
