Civil - Unlimited  PI/PD/WD - Other Discovery Hearing 37-2022-00043624-CU-PO-NC KAY VS. UNITED SITE SERVICES [IMAGED] CAUSAL DOCUMENT/DATE FILED: Motion to Compel Discovery, 04/12/2024
Defendant United Site Services, Inc.'s motion to compel discovery responses (ROA # 113) is granted.
The Court deems the lack of opposition to the motion to be a concession as to the merits of the motion.
Defendant propounded discovery requests (form interrogatories) on plaintiff Corrin Suzanne Kay on January 9, 2024. See Soll Dec. (ROA # 113), ¶ 3. No responses have been received as of this date. Id. at ¶ 10.
Plaintiff Corrin Suzanne Kay is ordered to provide verified responses to the Form Interrogatories pursuant to CCP § 2030.290(b). By failing to respond to the interrogatories in a timely fashion, plaintiff has waived the right to assert objections pursuant to CCP § 2030.290(a). Plaintiff Corrin Suzanne Kay's verified responses must be sent to Attorney Jeffrey Soll, 25350 Magic Mountain Parkway, Suite 250, Santa Clarita, California 91355 by no later than June 14, 2024.
The request for sanctions is granted pursuant to CCP § 2030.300(d) and 2023.010(h) in the amount of $285 (the court has deducted $337.50 from the amount sought because the motion is unopposed). The sanctions shall be paid by plaintiff Corrin Suzanne Kay to defendant United Site Services, Inc. on or before July 1, 2024.
This minute order constitutes the Court's order. No party is required to submit a proposed order after hearing.
This is the tentative ruling for an appearance (in person or remote) hearing at 1:30 p.m. on Friday, May 31, 2024. If no party appears at the hearing, this tentative ruling will become the order of the Court as of May 31, 2024. If the parties are satisfied with the Court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the Court and each other of their intention not to appear, though this notice is not required.
