CASE TITLE: CASE TYPE:

Civil - Unlimited  Breach of Contract/Warranty Discovery Hearing 37-2023-00025569-CU-BC-NC GREGORY M GARRISON APC VS GILL [IMAGED] CAUSAL DOCUMENT/DATE FILED: Motion - Other, 03/11/2024

In connection with Plaintiff Gregory M. Garrison, APC's motions to compel further responses to form interrogatories (ROA # 33) and request for production of documents (ROA # 37), the Court issues the following ruling: The Court has significant doubts about whether the moving party made 'a reasonable and good faith attempt at an informal resolution of each issue presented by the motion.' CCP § 2016.040.

In any event, it appears that the Defendant provided supplemental discovery responses after these motions were filed and, as such, it is not clear to the Court what issues, if any remain.

The Court orders both parties to appear personally at oral argument to meet and confer in person regarding any outstanding discovery issues. The Court intends to call the case and direct both counsel to meet and confer in the Court's ante room in an effort to resolve the discovery disputes. At the conclusion of the meet and confer, the parties should be prepared to address the Court regarding the outcome of the meet and confer.

Any discovery disputes remaining will be addressed on June 14, 2024 at 1:30 pm and the Court will direct the Plaintiff to file a concise statement addressing any unresolved discovery issues lumping together the discovery requests in a more manageable format for the Court by June 10, 2024 at noon.

The Court will address any remaining issues, including the requests for sanctions, on June 14, 2024.

This minute order constitutes the Court's order. No party is required to submit a proposed order after hearing.

This is the tentative ruling for an appearance (in person or remote) hearing at 1:30 p.m. on Friday, May 31, 2024. If no party appears at the hearing, this tentative ruling will become the order of the Court as of May 31, 2024. If the parties are satisfied with the Court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the Court and each other of their intention not to appear, though this notice is not required.
